Terms of Service

1. The service

Namaste Indian (“we”, “us”) provides a social platform including posts, profiles, feeds, news surfaces, Hub directories, messaging, and features such as Reels, Chat, or Marketplace. Features may change, pause, or close as we improve the product. The primary website is namaste-indian.com, with companion Android and iOS apps when available.

2. Governing law & Indian statutes

These Terms are governed by the laws of India. Subject to applicable consumer protections, courts in India have exclusive jurisdiction over disputes arising from the service. Without limiting the full text of the statutes, our operations and your use of Namaste Indian are informed by:

• Information Technology Act, 2000 (including provisions on intermediaries, cyber offences, and electronic records).
• IT (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 (due diligence, grievance redressal, and prohibited content categories for intermediaries).
• Digital Personal Data Protection Act, 2023 (personal data — see our Privacy Policy).
• Other applicable Indian laws, including the Indian Penal Code / Bharatiya Nyaya Sanhita where relevant to offline offences, and child-protection statutes such as Protection of Children from Sexual Offences Act, 2012 (POCSO).

Official texts and updates are published by Ministry of Electronics and Information Technology (MeitY) and on India Code. Links are for reference; the official gazette / India Code text prevails.

3. Eligibility & accounts

• You must be able to form a binding contract under applicable Indian law. The service is intended for users who are at least 13 years old. Under the DPDP Act, 2023, a child is under 18; if you are under 18, a parent or lawful guardian must consent to your use and to processing of your personal data as described in the Privacy Policy.
• Provide accurate registration details and keep your password secure.
• You are responsible for activity under your account.
• One person may keep multiple accounts on a device only where our product allows account switching; you must not create accounts to evade bans or amplify abuse.
• We may suspend or terminate accounts that break these Terms, our Community Guidelines, Child Safety Standards, or applicable law.

4. Your content

You keep ownership of content you post. By posting, you grant Namaste Indian a worldwide, non-exclusive, royalty-free licence to host, display, reproduce, and distribute that content on the service so others can see and interact with it, and to make technical copies needed to operate, secure, and moderate the platform. You can delete posts or your account subject to backups, legal holds, safety retention, and residual copies that age out of our systems over time.

You confirm you have the rights to post what you share, and that it does not infringe others’ rights or violate Indian law (including intellectual property, privacy, defamation, and child-protection laws).

5. Acceptable use

You must not use Namaste Indian to engage in conduct that is unlawful under Indian law or that violates the IT Rules’ prohibited categories, including (without limitation):

• Content that is grossly harmful, harassing, defamatory, obscene, pornographic, paedophilic, invasive of privacy, hateful, or otherwise unlawful.
• Content that harms minors, including any child sexual abuse material (CSAM) — see Child Safety.
• Content that infringes patents, trademarks, copyrights, or other proprietary rights.
• Content that deceives or misleads about the origin of a message, or impersonates another person.
• Content that threatens the unity, integrity, defence, security, or sovereignty of India; friendly relations with foreign states; public order; or that is insulting to another nation (as defined under applicable law and IT Rules).
• Content that contains software viruses or any other computer code designed to interrupt, destroy, or limit system functionality.
• Scams, spam, coordinated inauthentic behaviour, or abusive scraping / overloading of our systems.

6. Intermediary role

Namaste Indian hosts user-generated content and related services. We act as an intermediary under the IT Act, 2000, and observe due diligence expected under the IT Rules, 2021 — including publishing these Terms and Community Guidelines, enabling reporting, appointing a Grievance Officer, and acting on unlawful content when we obtain actual knowledge through a court or authorised government order, or through our grievance / report mechanisms as applicable.

Users are primarily responsible for content they upload. Third-party news headlines and external links may appear on the service; we do not control those publishers’ sites. See our Editorial standards.

7. Moderation & takedown

We may remove or limit content, and restrict accounts, when we believe it is needed to protect people, comply with law or authorised orders, or keep the platform usable. Reporting tools and staff review support that work; outcomes are not always public. Where required under the IT Rules, we aim to acknowledge and address grievances within the published timelines on our Grievance Officer page.

8. Copyright & IP complaints

Post only what you created or have permission to share. If you own rights in something posted on Namaste Indian without your permission, tell us and we will review it.

How to send a notice. Report the post in-app with the Copyright reason, or email the Grievance Officer with the subject Copyright complaint. Include:

• Identification of the work you say is infringed.
• The exact link (or username and post URL) of the material you want removed.
• Your name, address, email, and the rights you hold.
• A statement that you believe in good faith the use is not authorised by you, your agent, or the law.
• A statement that the information in your notice is accurate, and that you are the rights holder or authorised to act for them.

Incomplete notices slow things down — we may come back to you for the missing detail rather than act on a partial claim.

What we do. We review against these Terms and the Community Guidelines, and may remove or restrict the content. We notify the person who posted it and tell them what was removed and why — we do not share your identity with them beyond what the law requires.

If you think we got it wrong. The person whose content was removed can reply to our notice with a counter-statement explaining their licence, permission, or fair-dealing basis under the Copyright Act, 1957. We may restore content when the counter-statement holds up.

Repeat infringers. Accounts that repeatedly post infringing material may be limited, suspended, or removed. Filing knowingly false claims of ownership is itself a violation of these Terms.

Trademark and impersonation complaints follow the same route — use the subject Trademark complaint and include your registration details.

9. Rolling features

New or limited-rollout features are provided as-is, may be unreliable, and can be changed or withdrawn without notice.

10. Disclaimers

Namaste Indian is provided on an “as is” and “as available” basis. We do not guarantee uninterrupted service, perfect accuracy of third-party news feeds, or that every post is true. To the fullest extent allowed by Indian law, we disclaim warranties not expressly stated here. Nothing here excludes liability that cannot be excluded under applicable consumer or other mandatory law.

11. Liability

To the fullest extent permitted by law, Namaste Indian and its operators are not liable for indirect, incidental, or consequential damages arising from your use of the service. Nothing in these Terms limits liability that cannot be limited under applicable Indian law.

12. Privacy

How we handle personal data under the DPDP Act, 2023 and related practice is described in our Privacy Policy.

13. Grievance redressal

For complaints about content, accounts, or these Terms, contact our Grievance Officer at namasteindia.ap@gmail.com or use the Grievance Officer page. We aim to acknowledge grievances within 24 hours and resolve them within 15 days, as expected under the IT Rules, 2021.

14. App stores & licence (EULA)

These Terms are the Terms of Use / End User Licence Agreement (EULA) for Namaste Indian on the web, Google Play, and the Apple App Store. By installing or using the mobile apps, you agree to these Terms and the Privacy Policy.

• Google Play — licensed under these Terms; also subject to the Google Play Terms of Service between you and Google. We do not charge for the current Namaste Indian app listing.
• Apple App Store — licensed under these Terms as our custom EULA. Apple is not a party to these Terms and is not responsible for the app or its content. Inquiries about the app should go to Namaste Indian (see Contact), not Apple, except for App Store purchase / refund matters governed by Apple.
• Stable public URLs for store consoles: namaste-indian.com/terms (Terms of Use) and namaste-indian.com/privacy (Privacy Policy).

You may not reverse engineer, redistribute, or misuse the apps except as allowed by applicable law. App Store and Play builds may be updated or replaced without notice.

15. Changes

We may update these Terms. Continued use after changes take effect means you accept the updated Terms. Material changes will be reflected by the “Last updated” date on this page and, when appropriate, in-product notice.
